1. What this covers

These terms govern your use of swqos.com, a Solana transaction relay available at https://send.swqos.com and through the dashboard at swqos.com. By creating an account or submitting a transaction you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.

2. The service

swqos.com accepts already-signed Solana transactions and forwards the exact bytes you submit to the network over stake-weighted QoS connections. We do not modify, re-sign, reorder or inspect the contents of your transactions beyond validating that the envelope is well formed and extracting its signature.

What we provide is forwarding, not inclusion. An accepted receipt confirms that we forwarded your transaction and that an upstream connection acknowledged it. Whether a transaction is included in a block is determined by the Solana network and is outside our control. We make no representation that any transaction will land, land within any time, or land in any particular order.

3. Accounts and credentials

You are responsible for keeping your API key secret and for all activity conducted with it. The key cannot sign transactions or move funds from any wallet, but anyone holding it can spend your prepaid balance. Tell us at support@swqos.com immediately if you believe a key has been exposed.

You must provide an email address you control. We may suspend or close an account that is used for unlawful activity, that attempts to disrupt the service or other customers, or where we are required to do so by law.

4. Payment

The service is prepaid in native SOL. Each accepted submission is charged at the price shown on your account, which is 0.0002 SOL unless we have agreed otherwise in writing. The precise circumstances in which a charge applies are published in our billing documentation and form part of these terms.

Balances are not a deposit, are not held on trust, and do not earn interest. Because each submission is settled immediately against your balance, charges for submissions that were accepted and forwarded are final, including where the transaction does not subsequently land on chain. Where we fail to forward a submission, the charge is reversed automatically.

Unused balance remains available while your account is open. If you close your account, contact us and we will return any remaining balance to a Solana address you nominate, less any network fees.

We aim to keep the service available continuously and publish component health at https://send.swqos.com/v1/health. We do not currently offer a contractual uptime guarantee. We may perform maintenance, change or withdraw features, and will give reasonable notice of material changes where we can.

7. Liability

The service is provided as is. To the fullest extent permitted by law we exclude all implied warranties. We are not liable for trading losses, missed opportunities, transactions that do not land, network congestion, validator behaviour, or any indirect or consequential loss.

Where we are found liable despite the above, our total liability to you is limited to the amount you paid us in the three months preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded.

8. Changes

We may update these terms. Material changes will be announced by email to the address on your account at least fourteen days before they take effect. Continuing to use the service after that constitutes acceptance.
